A Comprehensive Review of the Civil Liberty Debate on Abortion Of all the issues plaguing the United States, currently and in the past, abortion rights have been one of the most passionately debated civil liberty issues. Edward Sidlow and Beth Henschen define civil liberties as ââ¬Å"Individual rights protected by the Constitution against the powers of the governmentâ⬠(72). Some argue that women should be protected from the powers of government in terms of reproductive rights while others argue that it is the duty of the government to protect the lives of everyone, including fetuses. This is such an important issue for Americans that it often dictates who a person votes for in elections; Republicans are most often pro-life and Democrats areâ⬠¦show more contentâ⬠¦The issue of abortion was debated amongst the American public but was not successfully addressed by the Supreme Court until the 1973 case, Roe v. Wade. In this landmark case, it was decided that the Due Process Clause of the Fourteenth Amendment protects the right to priva cy, which includes a woman s right to terminate her pregnancy. The case of Griswold v. Connecticut and the case of Roe v. Wade go hand in hand to guarantee women the right to privacy and therefore, the right to have an abortion. Further, pro-choice activists argue that not allowing a woman to control her own body violates her right to equal treatment under the law. In the 2007 Supreme Court case of Gonzales v. Carhart, Justice Ruth Bader Ginsburg dissented, ââ¬Å"â⬠¦Unà due restrictions on abortion proceduresâ⬠¦infringe upon a woman s autonomy to determine her life s course, and thus to enjoy equal citizenship statureâ⬠. Justice Ginsburg claimed that women should be free from state-imposed roles, meaning that some women know that they are not made to be mothers and denying those women an abortion denies them equal citizenship stature, seeing as men are not forced to become fathers. Many people believe that a baby should not come into the world unwanted; they argue th at denying women abortions may sometimes lead to certain unwanted outcomes.
